PLEASE READ THESE TERMS CAREFULLY BEFORE SUBSCRIBING to the “IPLAY Iwin PACK”. BY PROCEEDING WITH REGISTRATION/SUBSCRIPTION TO THE IPLAY Iwin PACK, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT SUBSCRIBE TO THE IPLAY Iwin PACK.

TERMS:

The IPLAY Iwin Pack is hosted by Seven3Rockers technologies Ltd., a company having its office at A-11 , Niti Bagh, New Delhi -49 (“Seven3Rockers”) in association with Aircel Limited, Dishnet Wireless Limited, Aircel cellular Limited, (hereinafter referred to as “Aircel India”) (jointly referred to as ‘Organizers’)and the pack is open for subscription for the pre-paid as well as post-paid category of Aircel cellular subscribers of (AP, ASSAM, BIHAR, DELHI,HARYANA, HP, KARNATAKA, KERALA, KOLKATA, MAHARASTRA, MUMBAI, NE,JNK, ORISSA, PUNJAB, RAJASTHAN, WEST BENGAL, UPE, UPW, ROTN, CHENNAI ) circles. The customers will be acquired on Aircel Iplay Iwin Contest, which is a perpetual contest in which the grand prize for the winners will be announced after  every 3 months.   The Current running contest will declare its winners on 3rd September, post the finishing of the contest, and before the next contest starts the very next day. Once the subscriber has subscribed to the IPLAY Iwin Pack, he/she will be allowed to participate in any Aircel Competition that may be launched as part of this Competition Pack.

* Validity of the IPLAY I Win Competition has been extended till the midnight of 2nd September 2013.

1 Subscriber shall mean the rightful user of the connection, in whose name the mobile phone number (MSISDN) is registered with the operator. In the event the User number / connection is registered in the name of a Company/ Firm, the employee who is authorized to use the phone shall submit a No Objection Certificate (NoC) and authorization of the employer duly permitting the employee to use the number for participation in the competition, receive the prizes and accept the terms applicable for the competition.

A Subscriber, by subscribing to the IPLAY Iwin Pack, hereby agrees to the Terms and Conditions mentioned below and gives his/her consent to the Terms and Conditions of any Competition that may be launched as part of this pack.

Also, by subscribing to this pack, you:

Warrant that you have read understood and agreed to conform to these Terms and Conditions.

Warrant the accuracy, truthfulness and currency of all information that you have submitted.

By subscribing to the Pack, you indicate your acknowledgement and acceptance of these Terms and Conditions.

1. 1.       To subscribe to the IPLAY Iwin Pack:

a)      The Aircel subscribers have to SMS < PLAY> to 51001 @ Rs.5/day or

b)     SMS <PLAY2> to 51001 to subscribe @ Rs.30/10 day.

c)      Dial the USSD string *122*31# @ Rs.5/day or

d)     Dial *122*91# @ Rs.30/10 day.

1. 2.       To Play IPLAY Iwin as Pay as you Play Customer:

a)      The Aircel subscribers have to SMS < IPLAY> to 510010 (Rs. 3/SMS)

Subscription to the Competition Pack is completely free.

On sending the request, the subscriber will receive an acknowledgement SMS telling him/her that his/her service request has been accepted and is being processed. He/she will then be sent an appropriate confirmation SMS once his/her request has been confirmed.

Once the customer becomes IPLAY Iwin pack member he/she will get an SMS informing about the current or upcoming competition, prizes to be won and that the competition can be played at just Rs.5/day , Rs.30/10 day or Rs.3/question.

If the subscription is unsuccessful, the user will be sent an appropriate SMS telling him/her to try again later.

All IPLAY Iwin Pack members will automatically be eligible to play all other competitions launched as part of the Competition Pack.

All IPLAY Iwin Pack subscribers will be charged Rs. 5/day or Rs.30/10 day ( depending on  the pack they are subscribed)- on all competition days, once they have subscribed to that particular competition unless the pricing has been revised for a particular competition or for all further competitions, in which case the price revision will be communicated in advance.

If an IPLAY Iwin Pack subscriber does not get charged for a day continuously for a period, the system will automatically deactivate the subscription to the pack.

If an IPLAY Iwin Pack subscriber wants to unsubscribe from this pack then it can be done by sending SMS UNSUB IPLAYIWN to 51001 or dial *122*0339#.

All Competition Pack members will be sent regular SMS updates and details about the current and the upcoming competitions.

All Competition Pack members will be eligible to play and win the prizes offered in each competition, as will be detailed in the Terms and Conditions of that respective competition. These prizes may vary from one competition to the next.

Pack Members will not be charged any amount on non-competition days (after the end of one competition, and before the start of the next competition).

1. A subscriber can subscribe and unsubscribe to the Competition Pack multiple times- i.e. if he/she unsubscribes from the Competition Pack, he/she can subscribe again, at any time, if he/she wishes to do so.

2. The prizes that the Competition Pack members might win, owing solely to his/her membership to the Competition Pack, will be sponsored and distributed by Seven3Rockers. These prizes shall be distributed by Seven3Rockers through any means, and at any time, as it may deem fit. Prizes will differ from one Competition to the next. These prizes will be mentioned in the individual competitions’ Terms & Conditions separately.

3. By subscribing to the Competition Pack, you confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and you agree to receive updates about current and upcoming competitions from Seven3Rockers/ the organizers, as they may in their sole and absolute discretion decide.

4. The Subscriber hereby understands and gives his/ her irrevocable consent for personal information relating to the Subscriber to be exchanged with Aircel, Seven3Rockers and its vendors or published and/or communicated to/in any media that it may deem fit, and Aircel, Seven3Rockers or its Vendors may, at their sole discretion choose to publish or disclose the name(s), phone number(s), score(s) and/or photographs of all/any Competition Pack subscribers/members, if required.

Organizers or their affiliates shall be entitled to use, in any manner, the details of the participants for their sales, marketing and promotional purposes, including the Prizes awarded to them, if any. By participating in the Competition, all participants hereby agree to the same. Organizers may, at their discretion, choose not to disclose the identity of the selected participant to other participants.

5. You acknowledge and agree that all copyright and trade marks and all other intellectual property rights in the SMS content/ WAP/ website and all material or content related to the Competition Pack shall remain, at all times, owned by Seven3Rockers/ the Organizers / their respective owners. All material and content contained in this website is made available for your personal and non-commercial use only. Any other use of the material/ content on this website/WAP site and/ or any information disseminated by SMS or any other means of communication is strictly prohibited.

6. All prizes must be claimed by the winners, along with the documents specified herein below. The documents required to be submitted along with the claim by the winners include the following (the document list is only inclusive and not exhaustive and can change as per the requirements of Law):

• Identity Proof
• Photocopy of PAN Card
• Address Proof
• Proof of holding the Aircel telephone connection
• Letter of Compliance with rules and regulations and declarations in the format as may be required by Aircel etc.

7. The employees of Aircel / Seven3Rockers and their group companies, affiliate or associate companies shall not be eligible to win any of the prizes offered in any of the Competitions launched as a part of the Competition Pack.

8. These Terms and Conditions are subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of Aircel/ Seven3Rockers.

9. The Terms and Conditions stated herein shall be read along with the Terms and Conditions of the Competitions that may be launched as part of the Aircel IPLAY Iwin Pack. In the event of any discrepancy between these Terms and Conditions and the Terms and Conditions of any specific Competition, the Terms and Conditions of such Competition shall override these Terms and Conditions.

10. These terms are subject to guidelines/ directions issued by the Department of Telecommunications (DoT), Telecom Regulatory Authority of India (TRAI) or any other statutory authority from time to time.

11. The decision of Aircel and Seven3Rockers in respect of all transactions/issues pertaining to the Competition Pack shall be final and binding.

12. Neither Aircel nor Seven3Rockers shall be responsible for any claims arising out of technical failures before, during, between or after the completion of any Competition in the Competition Pack, including but not limited to any technical failures in the telephone lines, failure of servers or the failure to provide the correct Competition score updates or any mistakes arising out of technical snags. Further, Seven3Rockers/Aircel shall not be responsible for any claims arising out of any failure(s) which is beyond the reasonable control of Seven3Rockers or Aircel.

13. The subscriber/member hereby agrees and undertakes not to hold Aircel/ Seven3Rockers and/or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or remote that you may/might have suffered, sustained or incurred, or claim to suffer, sustain or incur, by way of and /or on account of the Competition Pack or any related Competitions.

14. Aircel and Seven3Rockers reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify any part of the Competition Pack or any part thereof including the Terms and Conditions and prizes/gifts at their sole discretion at anytime during it’s validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the Subscriber/member. You are therefore advised to check this website regularly for any update(s) or amendment(s) made to these Terms and Conditions.

15. This Competition is being made purely on a “best effort” basis and participation of eligible subscribers is voluntary, and subject to acceptance of these Terms and Conditions.

16. These Terms & Conditions are subject to Indian Law and the exclusive jurisdiction of the Courts in New Delhi. Any and all disputes, controversies and conflicts (“Disputes”) arising out of the Competition shall be referred for Arbitration to any Officer designated by Organizers. The place of arbitration shall be New Delhi and the language used in the arbitral proceedings shall be English. Subject to the dispute resolution procedure as set out herein above, the Courts at New Delhi shall have the exclusive jurisdiction.

17. A person who has already won a prize will automatically disqualify from winning other prizes on any other SIM card in his/her name on which he/she is playing the contest. This is a skill based quiz and you should answer the quiz using your own skills only.

18. The contest will be discontinued in the circle which does not have a requisite number of players (which can be a number to be decided and will be an absolute discretion of the company).

TERMS AND CONDITIONS – IPLAY Iwin

1.“IPLAY Iwin Competition” (hereinafter referred to as the “Competition”) jointly organized by Aircel I Limited, Aircel Cellular Limited, Dishnet wireless Limited  (hereinafter referred to as “Aircel India”) and Seven3Rockers technologies Limited (Seven3Rockers), jointly referred to as ‘Organizers’ is launched as part of the IPLAY Iwin Pack, which is a perpetual contest,  and every contest is valid for 90 days, and the winners are declared accordingly. The current contest would be completed on 2nd September 2013 23:59:59 hrs* (hereinafter referred to as the “Competition Period”), after which the winners would be declared for the contest. Post this, the new contest would automatically start the next day for the subscribers and their scores will start afresh.Aircel India reserves the right to extend or shorten the Competition Period, as it deems fit.

2. The Competition is valid for all Valid Subscribers* i.e. both prepaid and postpaid of Aircel India (hereinafter referred to as “Subscribers”) residing in India who are above 18 years of age, in the circles (AP, ASSAM, BIHAR, DELHI, HP, KARNATAKA, KOLKATA, MAHARASTRA, MUMBAI, NE, ORISSA, JNK, PUNJAB, RAJASTHAN, WEST BENGAL, UPE, UPW, ROTN, CHENNAI) who successfully subscribe for the Competition Pack (hereinafter referred to as “Participant”) by following the process mentioned hereunder. Participating in this Competition by members of the IPLAY Iwin Pack is optional. The Competition will be available in the below mentioned languages:

*Valid Subscriber means having valid Subscription of Aircel cellular mobile telephony services as per Law.

An IPLay Iwin member, by subscribing to and/or participating in the competition, hereby agrees to the Terms and Conditions mentioned below and gives his/her consent to the process of selecting the winners as set out herein, and any appropriate changes that may be made to this competition by the Organizers due to any legal or regulatory requirement, instructions from any judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of Aircel/Seven3Rockers, its affiliates and associates.

Roaming callers should be barred from playing the Competition.

3. Procedure and Eligibility to participate:

The Competition is valid for all active Prepaid and Postpaid Aircel Subscribers who fulfil the following criteria:

Subscriber must be above 18 years of age.

Subscriber must be a citizen of India.

He/she must not have any been either convicted and / or prosecuted for commission of any criminal offence nor be of an unsound mind.

He/she must not be under any legal disability e.g. insolvency, restraint by court orders etc. and / or is prohibited from entering any contractual relationship.

Further, the winner will be the subscriber of the successful mobile phone number (MSISDN) and not the player, if such player is not the subscriber of such mobile number, as set out above. If the winner is not able to provide sufficient evidence to show that he/she is the subscriber of the mobile number, Aircel/Seven3Rockers reserves the right to award the prize to the next eligible winner or to forfeit the prize, at its sole discretion.

Participation in the Competition will be construed as an acknowledgement and acceptance of the Terms and Conditions set out herein and further agreed to be bound by the Terms and Conditions stated herein.

4. Subscription Process

Only Aircel subscribers (refer clause 2 above) will be eligible to participate in the IPLAY Iwin Competition.

Competition will be available on the toll-free shortcode 51001 for all subscribers of the Competition Pack.

All subscribed participants on the first day of the Competition will be charged as per the pricing they had opted for at the time of subscription from 01:00:00 hours onwards.

- If the charging is successful, participant will get a confirmation SMS, along with the rules, prizes, Terms and Conditions URL, keywords and the short code  on which he/she can SMS and participate in the Competition.

All participants who subscribe to the Competition Pack, after the Competition starts, will be charged as per the pricing they had opted for at the time of subscription.

- If the charging is successful, user will get a confirmation SMS, along with the rules, Prize details, Terms and Conditions URL , keywords and the short code  on which he/she can SMS and participate in the Competition.

On subsequent days, the system will try to charge all participants Rs.5/day or Rs.30/10 day depending on the pricing option they had opted for at the time of subscription- at 01:00:00 hours, irrespective of successful charging or failure the previous charging attempt. This charge will not be refunded to participants under any circumstances.

Subscribers that do not have Rs. 5 balance will be charged as mentioned below:

- If the charging is successful, user will get a confirmation SMS, along with the rules, Prizes, Terms and Conditions URL keywords and the short code  on which he/she can SMS and participate in the Competition.

Every day, all subscribed participants of the Competition Pack will be sent the charging success SMS (if the charging is successful), along with the question.

All subscribed participants will be charged from the first day of the Competition, or the day he/she subscribes to the Competition Pack, till the end of the Competition, or the day till he/she unsubscribes from the Competition Pack, whichever happens first.

If the subscriber wishes to unsubscribe from the Competition Pack, that can also be done by sending SMS UNSUB PLAYIWN to 51001.

There will be 1 attempt for charging every day. The attempt will be made 24 hrs post subscription/renewal attempt.

All subscribers of the Competition Pack can play the Competition, by sending SMS to the shortcode 51001, after being charged for the day.

Based on the amount charged, subscribers will be allowed to answer questions

o Subscribers that are charged Rs 5/day will get to answer 20 questions /day.

o Subscribers that are charged Rs 30/10 day will get to answer 20 questions for next 10 days.

The MSISDNs will be allowed to play the Competition, only after subscribing to the Competition Pack and after being charged for the day.

The confirmation SMS sent by the application that a participant has been charged will be sent only after 8 am and before 9 pm for the day even though that the charging would happen anytime between 01:00:00 hours and 23:59:59 hours.

• All active subscribers of Aircel can play the Contest, on a toll free shortcode, by sending ‘PLAY’ to 51001.
• As soon as a participant sends the keyword, the participant can play the challenge, only if the subscription fails for any reason, he/she would be stopped from playing.
• The confirmation SMS that a subscriber has been charged will be sent only between 8 am and 9 pm on any given day, even though the charging might happen at anytime between 01:00:00 hours and 23:59:59 hours.
• If the charging is not successful, then user will get an SMS saying he/she has not been charged.
• There will be a black-out time of 30 minutes (from 11:45 PM to 12:15 AM) during which the questions will be refreshed for the next day. This black-out time will be communicated to all the subscribers of Competition pack at the time of subscription. The participants will not be allowed to play the competition during this black-out time.
• If the application receives a response/keyword to 51001 at any time during this half hour, the member will be informed that the Competition is unavailable/is being refreshed and members can SMS after 12:15 AM to play the questions of the next day.
• If the application receives responses like PLAY A /B or A/B to 51001 after 12.15 am then that will be considered as response to the 1st question of the new day and based on the right answer configured for the 1st question of the day the response will be sent along with the next question.
• A participant can play the Competition by either sending the keyword “PLAY” to 51001 to get the question, or by sending a response to the question like “A or B” to 51001 as an answer to the question that he/she has last received on that day.
• The Competition consists of a total of 1200 questions with 2 answer options each. The participant can play only 20 questions a day. There will be a fresh set of 20 questions every day.
• For every right answer, the participant will score 2 point. There is no negative marking for a wrong answer.
• After every right/wrong answer, the user will be given his/her score for the day, followed by the next question and call-to-action.
• If the member gives an invalid input then an SMS is sent saying invalid answer, followed by how to answer and the same question and answer options.
• If the participant stops playing the challenge after answering the nth question then when he/she sends the keyword on the same day, he/she will get the (n+1)th question.
• If the user stops playing the competition, then he/she can continue playing either by sending SMS PLAY to 51001, on the same day, to receive the next question.
• The questions will be played sequentially.
• If a participant has answered only 3 questions the previous day and sends the answer to the 4th question the next day then the system will accept it as the response for the 1st question of the new day and give an appropriate response (right/wrong) along with the next question.
• Once the participant has played all the 20 questions for the day, he/she will receive an exit SMS informing him/her that he/she has reached the limit for the day, and can answer a fresh set of 20 questions the next day. The same will happen if the participant sends the keyword again after he/she has answered all the 20 questions for the day.
• But on the last day of competition, the exit text will not inform the subscriber that he/she can play the Competition on the next day.
• In case a participant experiences a delay in receiving a response or receives no response at all from the system, at any time during the challenge period, he/she should SMS the challenge keyword PLAY to the toll-free number 51001. The subscriber should refrain from sending the answer options, ‘A’ or ‘B’ in such a situation to 51001, as it might be considered as a reply to an unanswered question.
• The points scored by the participant in a day will get carried over to the next day. His/her score will be added at the end of each day.  The selection of the winner for weekly prize will be based only on the points scored by a participant in that week.
• All subscribers of the challenge who have NOT played the competition for the last 3 days will be sent an SMS asking them to play the competition by sending the keyword to 51001. This SMS will also contain the method of unsubscribing from the IPLAY Iwin competition pack so that subscribers are educated about the same.

5. Pay as you Play Subs:

• All active subscribers of Aircel can play the Contest, on a chargeable shortcode, by sending ‘IPLAY’ to 51001.
• As soon as a participant sends the keyword, the participant can play the challenge by sending the response to the chargeable shortcode 510010 (@Rs.3/SMS), only if the request fails for any reason, he/she would be stopped from playing.
• The confirmation SMS that a subscriber has been charged Rs.3 will be sent only between 8 am and 9 pm on any given day, even though the charging might happen at anytime between 01:00:00 hours and 23:59:59 hours.
• If the charging is not successful, then user will get an SMS saying he/she has not been charged.
• There will be a black-out time of 30 minutes (from 11:45 PM to 12:15 AM) during which the questions will be refreshed for the next day. This black-out time will be communicated to all the subscribers of Competition pack at the time of subscription. The participants will not be allowed to play the competition during this black-out time.
• If the application receives a response/keyword to 51001 /510010 at any time during this half hour, the member will be informed that the Competition is unavailable/is being refreshed and members can SMS after 12:15 AM to play the questions of the next day.
• If the application receives responses like PLAY A /B or A/B to 510010 after 12.15 am then that will be considered as response to the 1st question of the new day and based on the right answer configured for the 1st question of the day the response will be sent along with the next question.

• For every right answer, the participant will score 2 point. There is no negative marking for a wrong answer.
• After every right/wrong answer, the user will be given his/her score for the day, followed by the next question and call-to-action.
• If the member gives an invalid input then an SMS is sent saying invalid answer, followed by how to answer and the same question and answer options.
• If the participant stops playing the challenge after answering the nth question then when he/she sends the keyword on the same day, he/she will get the (n+1)th question.
• If the user stops playing the competition, then he/she can continue playing either by sending SMS IPLAY to 51001, on the same day, to receive the next question.
• The questions will be played sequentially.

• But on the last day of competition, the exit text will not inform the subscriber that he/she can play the Competition on the next day.
• In case a participant experiences a delay in receiving a response or receives no response at all from the system, at anytime during the challenge period, he/she should SMS the challenge keyword IPLAY to the toll-free number 51001. The subscriber should refrain from sending the answer options, ‘A’ or ‘B’ in such a situation to 510010, as it might be considered as a reply to an unanswered question.
• The points scored by the participant in a day will get carried over to the next day. His/her score will be added at the end of each day.  The selection of the winner for weekly prize will be based only on the points scored by a participant in that week.

PRIZES for IPLAY Iwin Subscription Pack Cutomer:

• Mega Prize: One MSISDN across the country, with the highest score will be selected as the winner of a Sports Bike OR Car.

• Grand Prize: 5 MSISDN with the highest score are selected as winner of LED.

• Month Prize: Top 5 scoring MSISDN each month will get a branded watch OR  cricketers autographed merchandize ( Cricket Bat, Stumps, T shirts, Posters, etc..).

• Weekly Prize: Top 2 scoring MSISDN where contest is live, with highest score at end of a week, are selected as the winner of a gift I POD of a branded store.

• Daily Prize: Top 5 scoring MSISDN where contest is live, with the highest score at the end of the day, are selected as winner of a 100 rupees recharge.

Selection of winners:

• Mega Prize: One MSISDN across the country, charged on all the 90 charged days, will be selected as the winner of Mega Prize. Only the scores of days on which the MSISDN was charged will be considered. In case of a tie, the winner will be selected through a random system generated process which will be scrutinized by an independent audit mechanism.

•  Grand Prize: Only the top scoring MSISDN in the circles where contest is live, charged on all the 90 charged days, will be considered eligible for Grand Prize. Only the scores of days on which the MSISDN was charged will be considered. In case of a tie, the winner will be selected through a random system generated process which will be scrutinized by an independent audit mechanism.

• Monthly Prize: Only the top scoring MSISDN in the circles where contest is live, charged on all the 30 charged days, will be considered eligible for Month 1 prize. Only the scores of days on which the MSISDN was charged will be considered. In case of a tie, the winner will be selected through a random system generated process which will be scrutinized by an independent audit mechanism. One MSISDN cannot win a monthly prize more than once in the challenge.

• Weekly Prize: Only the top scoring MSISDN in the circles where contest is live charged on all the 7 charged days will be considered eligible for Weekly prize. Only the scores of days on which the MSISDN was charged will be considered. In case of a tie, the winner will be selected through a random system generated process which will be scrutinized by an independent audit mechanism. One MSISDN cannot win a weekly prize more than once in the challenge.

If a participant plays the contest every day, his/her score will be added at the end of each charged day. i.e. if the participant has started playing the contest on day 1 and has scored 2 points, if he/she drops the game and resumes playing through SMS on day 3, he/she will be given fresh questions for day 4 (one by one), and if he/she answers the question correctly, his/her score will be 4. And this will be the score that will be considered for the winner selection for all the prizes.

The list of winners of all prizes will be announced after the end of the Competition and after all the winner selection processes are completed.

All the prizes in this Competition will be sponsored and distributed by Seven3Rockers.

Gratification Distribution Guidelines:

All prizes will be given after deducting various taxes, license fees and charges as applicable.

The Subscribers/participants/winners hereby irrevocably authorize Aircel India, that the data gathered during and/or after the Competition in respect of the participants (including Subscriber name and photograph etc.) shall be the property of Aircel India and Aircel India and its subsidiaries and shall be entitled to use the same in its any communications including marketing promotions and advertisements along with/without Aircel India’s brand.

1. The Subscriber, who is accessing the Competition through free /confessional /complementary SMS tariff, shall not be entitled for the Prizes.
2. The Winners’ names will be announced as registered in the system of Aircel India.

The IPLAY Iwin Pack is hosted by Seven3Rockers technologies Ltd., a company having its office at A-11 , Niti Bagh, New Delhi -49 (“Seven3Rockers”) in association with Aircel Limited, Dishnet Wireless Limited, Aircel cellular Limited, (hereinafter referred to as “Aircel India”) (jointly referred to as ‘Organizers’)and the pack is open for subscription for the pre-paid as well as post-paid category of Aircel cellular subscribers of (AP, ASSAM, BIHAR, DELHI,HARYANA, HP, KARNATAKA, KERALA, KOLKATA, MAHARASTRA, MUMBAI, NE,JNK, ORISSA, PUNJAB, RAJASTHAN, WEST BENGAL, UPE and UPW) circles. Subscription to this pack is valid from 01^st March 2013 to 31^st May 2013*. Once the subscriber has subscribed to the IPLAY Iwin Pack, he/she will be allowed to participate in any Aircel Competition that may be launched as part of this Competition Pack.

* Validity of the IPLAY I Win Competition has been extended till the midnight of 31^st May 2013.

1 Subscriber shall mean the rightful user of the connection, in whose name the mobile phone number (MSISDN) is registered with the operator. In the event the User number / connection is registered in the name of a Company/ Firm, the employee who is authorized to use the phone shall submit a No Objection Certificate (NoC) and authorization of the employer duly permitting the employee to use the number for participation in the competition, receive the prizes and accept the terms applicable for the competition.

A Subscriber, by subscribing to the IPLAY Iwin Pack, hereby agrees to the Terms and Conditions mentioned below and gives his/her consent to the Terms and Conditions of any Competition that may be launched as part of this pack.

1. 2.       To Play IPLAY Iwin as Pay as you Play Customer:

a)      The Aircel subscribers have to SMS < IPLAY> to 510010 (Rs. 3/SMS)

Subscription to the Competition Pack is completely free.

On sending the request, the subscriber will receive an acknowledgement SMS telling him/her that his/her service request has been accepted and is being processed. He/she will then be sent an appropriate confirmation SMS once his/her request has been confirmed.

Once the customer becomes IPLAY Iwin pack member he/she will get an SMS informing about the current or upcoming competition, prizes to be won and that the competition can be played at just Rs.5/day , Rs.30/10 day or Rs.3/question.

If the subscription is unsuccessful, the user will be sent an appropriate SMS telling him/her to try again later.

All IPLAY Iwin Pack members will automatically be eligible to play all other competitions launched as part of the Competition Pack.

All IPLAY Iwin Pack subscribers will be charged Rs. 5/day or Rs.30/10 day ( depending on  the pack they are subscribed)- on all competition days, once they have subscribed to that particular competition unless the pricing has been revised for a particular competition or for all further competitions, in which case the price revision will be communicated in advance.

If an IPLAY Iwin Pack subscriber does not get charged for a day continuously for a period, the system will automatically deactivate the subscription to the pack.

If an IPLAY Iwin Pack subscriber wants to unsubscribe from this pack then it can be done by sending SMS UNSUB IPLAYIWN to 51001 or dial *122*0339#.

All Competition Pack members will be sent regular SMS updates and details about the current and the upcoming competitions.

All Competition Pack members will be eligible to play and win the prizes offered in each competition, as will be detailed in the Terms and Conditions of that respective competition. These prizes may vary from one competition to the next.

Pack Members will not be charged any amount on non-competition days (after the end of one competition, and before the start of the next competition).

1. A subscriber can subscribe and unsubscribe to the Competition Pack multiple times- i.e. if he/she unsubscribes from the Competition Pack, he/she can subscribe again, at any time, if he/she wishes to do so.

2. The prizes that the Competition Pack members might win, owing solely to his/her membership to the Competition Pack, will be sponsored and distributed by Seven3Rockers. These prizes shall be distributed by Seven3Rockers through any means, and at any time, as it may deem fit. Prizes will differ from one Competition to the next. These prizes will be mentioned in the individual competitions’ Terms & Conditions separately.

3. By subscribing to the Competition Pack, you confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and you agree to receive updates about current and upcoming competitions from Seven3Rockers/ the organizers, as they may in their sole and absolute discretion decide.

4. The Subscriber hereby understands and gives his/ her irrevocable consent for personal information relating to the Subscriber to be exchanged with Aircel, Seven3Rockers and its vendors or published and/or communicated to/in any media that it may deem fit, and Aircel, Seven3Rockers or its Vendors may, at their sole discretion choose to publish or disclose the name(s), phone number(s), score(s) and/or photographs of all/any Competition Pack subscribers/members, if required.

Organizers or their affiliates shall be entitled to use, in any manner, the details of the participants for their sales, marketing and promotional purposes, including the Prizes awarded to them, if any. By participating in the Competition, all participants hereby agree to the same. Organizers may, at their discretion, choose not to disclose the identity of the selected participant to other participants.

5. You acknowledge and agree that all copyright and trade marks and all other intellectual property rights in the SMS content/ WAP/ website and all material or content related to the Competition Pack shall remain, at all times, owned by Seven3Rockers/ the Organizers / their respective owners. All material and content contained in this website is made available for your personal and non-commercial use only. Any other use of the material/ content on this website/WAP site and/ or any information disseminated by SMS or any other means of communication is strictly prohibited.

6. All prizes must be claimed by the winners, along with the documents specified herein below. The documents required to be submitted along with the claim by the winners include the following (the document list is only inclusive and not exhaustive and can change as per the requirements of Law):

• Identity Proof
• Photocopy of PAN Card
• Address Proof
• Proof of holding the Aircel telephone connection
• Letter of Compliance with rules and regulations and declarations in the format as may be required by Aircel etc.

7. The employees of Aircel / Seven3Rockers and their group companies, affiliate or associate companies shall not be eligible to win any of the prizes offered in any of the Competitions launched as a part of the Competition Pack.

8. These Terms and Conditions are subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of Aircel/ Seven3Rockers.

9. The Terms and Conditions stated herein shall be read along with the Terms and Conditions of the Competitions that may be launched as part of the Aircel IPLAY Iwin Pack. In the event of any discrepancy between these Terms and Conditions and the Terms and Conditions of any specific Competition, the Terms and Conditions of such Competition shall override these Terms and Conditions.

10. These terms are subject to guidelines/ directions issued by the Department of Telecommunications (DoT), Telecom Regulatory Authority of India (TRAI) or any other statutory authority from time to time.

11. The decision of Aircel and Seven3Rockers in respect of all transactions/issues pertaining to the Competition Pack shall be final and binding.

12. Neither Aircel nor Seven3Rockers shall be responsible for any claims arising out of technical failures before, during, between or after the completion of any Competition in the Competition Pack, including but not limited to any technical failures in the telephone lines, failure of servers or the failure to provide the correct Competition score updates or any mistakes arising out of technical snags. Further, Seven3Rockers/Aircel shall not be responsible for any claims arising out of any failure(s) which is beyond the reasonable control of Seven3Rockers or Aircel.

13. The subscriber/member hereby agrees and undertakes not to hold Aircel/ Seven3Rockers and/or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or remote that you may/might have suffered, sustained or incurred, or claim to suffer, sustain or incur, by way of and /or on account of the Competition Pack or any related Competitions.

14. Aircel and Seven3Rockers reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify any part of the Competition Pack or any part thereof including the Terms and Conditions and prizes/gifts at their sole discretion at anytime during it’s validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the Subscriber/member. You are therefore advised to check this website regularly for any update(s) or amendment(s) made to these Terms and Conditions.

15. This Competition is being made purely on a “best effort” basis and participation of eligible subscribers is voluntary, and subject to acceptance of these Terms and Conditions.

16. These Terms & Conditions are subject to Indian Law and the exclusive jurisdiction of the Courts in New Delhi. Any and all disputes, controversies and conflicts (“Disputes”) arising out of the Competition shall be referred for Arbitration to any Officer designated by Organizers. The place of arbitration shall be New Delhi and the language used in the arbitral proceedings shall be English. Subject to the dispute resolution procedure as set out herein above, the Courts at New Delhi shall have the exclusive jurisdiction.

17. A person who has already won a prize will automatically disqualify from winning other prizes on any other SIM card in his/her name on which he/she is playing the contest. This is a skill based quiz and you should answer the quiz using your own skills only.

18. The contest will be discontinued in the circle which does not have a requisite number of players (which can be a number to be decided and will be an absolute discretion of the company).

TERMS AND CONDITIONS – IPLAY Iwin

1.“IPLAY Iwin Competition” (hereinafter referred to as the “Competition”) jointly organized by Aircel I Limited, Aircel Cellular Limited, Dishnet wireless Limited  (hereinafter referred to as “Aircel India”) and Seven3Rockers technologies Limited (Seven3Rockers), jointly referred to as ‘Organizers’ is launched as part of the IPLAY Iwin Pack and is valid during the period from 1^st March 2013 00:00:01 hrs to 31^st May 2013 23:59:59 hrs* (hereinafter referred to as the “Competition Period”). Aircel India reserves the right to extend or shorten the Competition Period, as it deems fit.

* “Competition period” for IPLAY I Win Competition has been extended till the midnight of 31^st May 2013.

2. The Competition is valid for all Valid Subscribers* i.e. both prepaid and postpaid of Aircel India (hereinafter referred to as “Subscribers”) residing in India who are above 18 years of age, in the circles (AP, ASSAM, BIHAR, DELHI, HP, KARNATAKA, KOLKATA, MAHARASTRA, MUMBAI, NE, ORISSA, JNK, PUNJAB, RAJASTHAN, WEST BENGAL, UPE) who successfully subscribe for the Competition Pack (hereinafter referred to as “Participant”) by following the process mentioned hereunder. Participating in this Competition by members of the IPLAY Iwin Pack is optional. The Competition will be available in the below mentioned languages:

*Valid Subscriber means having valid Subscription of Aircel cellular mobile telephony services as per Law.

An IPLay Iwin member, by subscribing to and/or participating in the competition, hereby agrees to the Terms and Conditions mentioned below and gives his/her consent to the process of selecting the winners as set out herein, and any appropriate changes that may be made to this competition by the Organizers due to any legal or regulatory requirement, instructions from any judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of Aircel/Seven3Rockers, its affiliates and associates.

Roaming callers should be barred from playing the Competition.

3. Procedure and Eligibility to participate:

The Competition is valid for all active Prepaid and Postpaid Aircel Subscribers who fulfil the following criteria:

Subscriber must be above 18 years of age.

Subscriber must be a citizen of India.

He/she must not have any been either convicted and / or prosecuted for commission of any criminal offence nor be of an unsound mind.

He/she must not be under any legal disability e.g. insolvency, restraint by court orders etc. and / or is prohibited from entering any contractual relationship.

Further, the winner will be the subscriber of the successful mobile phone number (MSISDN) and not the player, if such player is not the subscriber of such mobile number, as set out above. If the winner is not able to provide sufficient evidence to show that he/she is the subscriber of the mobile number, Aircel/Seven3Rockers reserves the right to award the prize to the next eligible winner or to forfeit the prize, at its sole discretion.

Participation in the Competition will be construed as an acknowledgement and acceptance of the Terms and Conditions set out herein and further agreed to be bound by the Terms and Conditions stated herein.

4. Subscription Process

Only Aircel subscribers (refer clause 2 above) will be eligible to participate in the IPLAY Iwin Competition.

Competition will be available on the toll-free shortcode 51001 for all subscribers of the Competition Pack.

All subscribed participants on the first day of the Competition will be charged as per the pricing they had opted for at the time of subscription from 01:00:00 hours onwards.

- If the charging is successful, participant will get a confirmation SMS, along with the rules, prizes, Terms and Conditions URL, keywords and the short code  on which he/she can SMS and participate in the Competition.

All participants who subscribe to the Competition Pack, after the Competition starts, will be charged as per the pricing they had opted for at the time of subscription.

- If the charging is successful, user will get a confirmation SMS, along with the rules, Prize details, Terms and Conditions URL , keywords and the short code  on which he/she can SMS and participate in the Competition.

On subsequent days, the system will try to charge all participants Rs.5/day or Rs.30/10 day depending on the pricing option they had opted for at the time of subscription- at 01:00:00 hours, irrespective of successful charging or failure the previous charging attempt. This charge will not be refunded to participants under any circumstances.

Subscribers that do not have Rs. 5 balance will be charged as mentioned below:

- If the charging is successful, user will get a confirmation SMS, along with the rules, Prizes, Terms and Conditions URL keywords and the short code  on which he/she can SMS and participate in the Competition.

Every day, all subscribed participants of the Competition Pack will be sent the charging success SMS (if the charging is successful), along with the question.

All subscribed participants will be charged from the first day of the Competition, or the day he/she subscribes to the Competition Pack, till the end of the Competition, or the day till he/she unsubscribes from the Competition Pack, whichever happens first.

If the subscriber wishes to unsubscribe from the Competition Pack, that can also be done by sending SMS UNSUB PLAYIWN to 51001.

There will be 1 attempt for charging every day. The attempt will be made 24 hrs post subscription/renewal attempt.

All subscribers of the Competition Pack can play the Competition, by sending SMS to the shortcode 51001, after being charged for the day.

Based on the amount charged, subscribers will be allowed to answer questions

o Subscribers that are charged Rs 5/day will get to answer 20 questions /day.

o Subscribers that are charged Rs 30/10 day will get to answer 20 questions for next 10 days.

The MSISDNs will be allowed to play the Competition, only after subscribing to the Competition Pack and after being charged for the day.

The confirmation SMS sent by the application that a participant has been charged will be sent only after 8 am and before 9 pm for the day even though that the charging would happen anytime between 01:00:00 hours and 23:59:59 hours.

• All active subscribers of Aircel can play the Contest, on a toll free shortcode, by sending ‘PLAY’ to 51001.
• As soon as a participant sends the keyword, the participant can play the challenge, only if the subscription fails for any reason, he/she would be stopped from playing.
• The confirmation SMS that a subscriber has been charged will be sent only between 8 am and 9 pm on any given day, even though the charging might happen at anytime between 01:00:00 hours and 23:59:59 hours.
• If the charging is not successful, then user will get an SMS saying he/she has not been charged.
• There will be a black-out time of 30 minutes (from 11:45 PM to 12:15 AM) during which the questions will be refreshed for the next day. This black-out time will be communicated to all the subscribers of Competition pack at the time of subscription. The participants will not be allowed to play the competition during this black-out time.
• If the application receives a response/keyword to 51001 at any time during this half hour, the member will be informed that the Competition is unavailable/is being refreshed and members can SMS after 12:15 AM to play the questions of the next day.
• If the application receives responses like PLAY A /B or A/B to 51001 after 12.15 am then that will be considered as response to the 1st question of the new day and based on the right answer configured for the 1st question of the day the response will be sent along with the next question.
• A participant can play the Competition by either sending the keyword “PLAY” to 51001 to get the question, or by sending a response to the question like “A or B” to 51001 as an answer to the question that he/she has last received on that day.
• The Competition consists of a total of 1200 questions with 2 answer options each. The participant can play only 20 questions a day. There will be a fresh set of 20 questions every day.
• For every right answer, the participant will score 2 point. There is no negative marking for a wrong answer.
• After every right/wrong answer, the user will be given his/her score for the day, followed by the next question and call-to-action.
• If the member gives an invalid input then an SMS is sent saying invalid answer, followed by how to answer and the same question and answer options.
• If the participant stops playing the challenge after answering the nth question then when he/she sends the keyword on the same day, he/she will get the (n+1)th question.
• If the user stops playing the competition, then he/she can continue playing either by sending SMS PLAY to 51001, on the same day, to receive the next question.
• The questions will be played sequentially.
• If a participant has answered only 3 questions the previous day and sends the answer to the 4th question the next day then the system will accept it as the response for the 1st question of the new day and give an appropriate response (right/wrong) along with the next question.
• Once the participant has played all the 20 questions for the day, he/she will receive an exit SMS informing him/her that he/she has reached the limit for the day, and can answer a fresh set of 20 questions the next day. The same will happen if the participant sends the keyword again after he/she has answered all the 20 questions for the day.
• But on the last day of competition, the exit text will not inform the subscriber that he/she can play the Competition on the next day.
• In case a participant experiences a delay in receiving a response or receives no response at all from the system, at any time during the challenge period, he/she should SMS the challenge keyword PLAY to the toll-free number 51001. The subscriber should refrain from sending the answer options, ‘A’ or ‘B’ in such a situation to 51001, as it might be considered as a reply to an unanswered question.
• The points scored by the participant in a day will get carried over to the next day. His/her score will be added at the end of each day.  The selection of the winner for weekly prize will be based only on the points scored by a participant in that week.
• All subscribers of the challenge who have NOT played the competition for the last 3 days will be sent an SMS asking them to play the competition by sending the keyword to 51001. This SMS will also contain the method of unsubscribing from the IPLAY Iwin competition pack so that subscribers are educated about the same.

5. Pay as you Play Subs:

• All active subscribers of Aircel can play the Contest, on a chargeable shortcode, by sending ‘IPLAY’ to 51001.
• As soon as a participant sends the keyword, the participant can play the challenge by sending the response to the chargeable shortcode 510010 (@Rs.3/SMS), only if the request fails for any reason, he/she would be stopped from playing.
• The confirmation SMS that a subscriber has been charged Rs.3 will be sent only between 8 am and 9 pm on any given day, even though the charging might happen at anytime between 01:00:00 hours and 23:59:59 hours.
• If the charging is not successful, then user will get an SMS saying he/she has not been charged.
• There will be a black-out time of 30 minutes (from 11:45 PM to 12:15 AM) during which the questions will be refreshed for the next day. This black-out time will be communicated to all the subscribers of Competition pack at the time of subscription. The participants will not be allowed to play the competition during this black-out time.
• If the application receives a response/keyword to 51001 /510010 at any time during this half hour, the member will be informed that the Competition is unavailable/is being refreshed and members can SMS after 12:15 AM to play the questions of the next day.

• For every right answer, the participant will score 2 point. There is no negative marking for a wrong answer.
• After every right/wrong answer, the user will be given his/her score for the day, followed by the next question and call-to-action.
• If the member gives an invalid input then an SMS is sent saying invalid answer, followed by how to answer and the same question and answer options.
• If the participant stops playing the challenge after answering the nth question then when he/she sends the keyword on the same day, he/she will get the (n+1)th question.
• If the user stops playing the competition, then he/she can continue playing either by sending SMS IPLAY to 51001, on the same day, to receive the next question.
• The questions will be played sequentially.
• If a participant has answered only 3 questions the previous day and sends the answer to the 4th question the next day then the system will accept it as the response for the 1st question of the new day and give an appropriate response (right/wrong) along with the next question.
• Once the participant has played all the 25 questions or answered first 20 questions correctly for the day, he/she will receive an exit SMS informing him/her that he/she has reached the limit for the day, and can answer a fresh set of 25 questions the next day. The same will happen if the participant sends the keyword again after he/she has answered all the 25 questions or answered first 20 questions correctly for the day.
• But on the last day of competition, the exit text will not inform the subscriber that he/she can play the Competition on the next day.
• In case a participant experiences a delay in receiving a response or receives no response at all from the system, at anytime during the challenge period, he/she should SMS the challenge keyword IPLAY to the toll-free number 51001. The subscriber should refrain from sending the answer options, ‘A’ or ‘B’ in such a situation to 510010, as it might be considered as a reply to an unanswered question.
• The points scored by the participant in a day will get carried over to the next day. His/her score will be added at the end of each day.  The selection of the winner for weekly prize will be based only on the points scored by a participant in that week.

PRIZES:

• Mega Prize: One MSISDN across the country, with the highest score, will be selected as the winner of Car worth Rs. 6 lakh.

• Grand Prize: 5 MSISDN across the country where the contest is live, the highest scorers are selected as winners of a Samsung Galaxy Tab 2.

• Month Prize: 5 MSISDN in top  revenue circles where contest is live, with the highest score at the end of the month, are selected as the winner of an IPL Tickets and a chance to meet a IPL Cricketer/ Players autographed merchandize ( Cricket Bat, Stumps, T shirts, Posters, etc.) / IPL watches.
• Weekly Prize: 2 MSISDN in top revenue circles where contest is live, with the highest score at the end of a week, are selected as the winner a gold coin of 2gm each.

Selection of winners:

•  Grand Prize: Only the top scoring MSISDN in the circles where contest is live, charged on all the 90 charged days, will be considered eligible for Grand Prize. In case of a tie, the winner will be selected through a random system generated process which will be scrutinized by an independent audit mechanism. One MSISDN cannot win a monthly prize more than once in the challenge.

• Weekly Prize: Only the top scoring MSISDN in the circles where contest is live charged on all the 7 charged days will be considered eligible for Weekly prize. Only the scores of days on which the MSISDN was charged will be considered. In case of a tie, the winner will be selected through a random system generated process which will be scrutinized by an independent audit mechanism. One MSISDN cannot win a weekly prize more than once in the challenge.

If a participant plays the contest every day, his/her score will be added at the end of each charged day. i.e. if the participant has started playing the contest on day 1 and has scored 2 points, if he/she drops the game and resumes playing through SMS on day 3, he/she will be given fresh questions for day 4 (one by one), and if he/she answers the question correctly, his/her score will be 4. And this will be the score that will be considered for the winner selection for all the prizes.

The list of winners of all prizes will be announced after the end of the Competition and after all the winner selection processes are completed.

All the prizes in this Competition will be sponsored and distributed by Seven3Rockers.

Gratification Distribution Guidelines:

All prizes will be given after deducting various taxes, license fees and charges as applicable.

The Subscribers/participants/winners hereby irrevocably authorize Aircel India, that the data gathered during and/or after the Competition in respect of the participants (including Subscriber name and photograph etc.) shall be the property of Aircel India and Aircel India and its subsidiaries and shall be entitled to use the same in its any communications including marketing promotions and advertisements along with/without Aircel India’s brand.

The IPLAY Iwin Pack is hosted by Seven3Rockers technologies Ltd., a company having its office at A-11 , Niti Bagh, New Delhi -49 (“Seven3Rockers”) in association with Aircel Limited, Dishnet Wireless Limited, Aircel cellular Limited, (hereinafter referred to as “Aircel India”) (jointly referred to as ‘Organizers’)and the pack is open for subscription for the pre-paid as well as post-paid category of Aircel cellular subscribers of (AP, ASSAM, BIHAR, DELHI,HARYANA, HP, KARNATAKA, KERALA, KOLKATA, MAHARASTRA, MUMBAI, NE,JNK, ORISSA, PUNJAB, RAJASTHAN, WEST BENGAL, UPE and UPW) circles. Subscription to this pack is valid from 01^st March 2013 to 31^st May 2013*. Once the subscriber has subscribed to the IPLAY Iwin Pack, he/she will be allowed to participate in any Aircel Competition that may be launched as part of this Competition Pack.

 * Validity of the IPLAY I Win Competition has been extended till the midnight of 31^st May 2013.

1 Subscriber shall mean the rightful user of the connection, in whose name the mobile phone number (MSISDN) is registered with the operator. In the event the User number / connection is registered in the name of a Company/ Firm, the employee who is authorized to use the phone shall submit a No Objection Certificate (NoC) and authorization of the employer duly permitting the employee to use the number for participation in the competition, receive the prizes and accept the terms applicable for the competition.

A Subscriber, by subscribing to the IPLAY Iwin Pack, hereby agrees to the Terms and Conditions mentioned below and gives his/her consent to the Terms and Conditions of any Competition that may be launched as part of this pack.

a)      The Aircel subscribers have to SMS < IPLAY> to 510010 (Rs. 3/SMS)

Subscription to the Competition Pack is completely free.

On sending the request, the subscriber will receive an acknowledgement SMS telling him/her that his/her service request has been accepted and is being processed. He/she will then be sent an appropriate confirmation SMS once his/her request has been confirmed.

Once the customer becomes IPLAY Iwin pack member he/she will get an SMS informing about the current or upcoming competition, prizes to be won and that the competition can be played at just Rs.5/day , Rs.30/10 day or Rs.3/question.

If the subscription is unsuccessful, the user will be sent an appropriate SMS telling him/her to try again later.

All IPLAY Iwin Pack members will automatically be eligible to play all other competitions launched as part of the Competition Pack.

All IPLAY Iwin Pack subscribers will be charged Rs. 5/day or Rs.30/10 day ( depending on  the pack they are subscribed)- on all competition days, once they have subscribed to that particular competition unless the pricing has been revised for a particular competition or for all further competitions, in which case the price revision will be communicated in advance.

If an IPLAY Iwin Pack subscriber does not get charged for a day continuously for a period, the system will automatically deactivate the subscription to the pack.

If an IPLAY Iwin Pack subscriber wants to unsubscribe from this pack then it can be done by sending SMS UNSUB IPLAYIWN to 51001 or dial *122*0339#.

All Competition Pack members will be sent regular SMS updates and details about the current and the upcoming competitions.

All Competition Pack members will be eligible to play and win the prizes offered in each competition, as will be detailed in the Terms and Conditions of that respective competition. These prizes may vary from one competition to the next.

Pack Members will not be charged any amount on non-competition days (after the end of one competition, and before the start of the next competition).

1. A subscriber can subscribe and unsubscribe to the Competition Pack multiple times- i.e. if he/she unsubscribes from the Competition Pack, he/she can subscribe again, at any time, if he/she wishes to do so.

2. The prizes that the Competition Pack members might win, owing solely to his/her membership to the Competition Pack, will be sponsored and distributed by Seven3Rockers. These prizes shall be distributed by Seven3Rockers through any means, and at any time, as it may deem fit. Prizes will differ from one Competition to the next. These prizes will be mentioned in the individual competitions’ Terms & Conditions separately.

3. By subscribing to the Competition Pack, you confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and you agree to receive updates about current and upcoming competitions from Seven3Rockers/ the organizers, as they may in their sole and absolute discretion decide.

4. The Subscriber hereby understands and gives his/ her irrevocable consent for personal information relating to the Subscriber to be exchanged with Aircel, Seven3Rockers and its vendors or published and/or communicated to/in any media that it may deem fit, and Aircel, Seven3Rockers or its Vendors may, at their sole discretion choose to publish or disclose the name(s), phone number(s), score(s) and/or photographs of all/any Competition Pack subscribers/members, if required.

Organizers or their affiliates shall be entitled to use, in any manner, the details of the participants for their sales, marketing and promotional purposes, including the Prizes awarded to them, if any. By participating in the Competition, all participants hereby agree to the same. Organizers may, at their discretion, choose not to disclose the identity of the selected participant to other participants.

5. You acknowledge and agree that all copyright and trade marks and all other intellectual property rights in the SMS content/ WAP/ website and all material or content related to the Competition Pack shall remain, at all times, owned by Seven3Rockers/ the Organizers / their respective owners. All material and content contained in this website is made available for your personal and non-commercial use only. Any other use of the material/ content on this website/WAP site and/ or any information disseminated by SMS or any other means of communication is strictly prohibited.

6. All prizes must be claimed by the winners, along with the documents specified herein below. The documents required to be submitted along with the claim by the winners include the following (the document list is only inclusive and not exhaustive and can change as per the requirements of Law):

• Identity Proof
• Photocopy of PAN Card
• Address Proof
• Proof of holding the Aircel telephone connection
• Letter of Compliance with rules and regulations and declarations in the format as may be required by Aircel etc.

7. The employees of Aircel / Seven3Rockers and their group companies, affiliate or associate companies shall not be eligible to win any of the prizes offered in any of the Competitions launched as a part of the Competition Pack.

8. These Terms and Conditions are subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of Aircel/ Seven3Rockers.

9. The Terms and Conditions stated herein shall be read along with the Terms and Conditions of the Competitions that may be launched as part of the Aircel IPLAY Iwin Pack. In the event of any discrepancy between these Terms and Conditions and the Terms and Conditions of any specific Competition, the Terms and Conditions of such Competition shall override these Terms and Conditions.

10. These terms are subject to guidelines/ directions issued by the Department of Telecommunications (DoT), Telecom Regulatory Authority of India (TRAI) or any other statutory authority from time to time.

11. The decision of Aircel and Seven3Rockers in respect of all transactions/issues pertaining to the Competition Pack shall be final and binding.

12. Neither Aircel nor Seven3Rockers shall be responsible for any claims arising out of technical failures before, during, between or after the completion of any Competition in the Competition Pack, including but not limited to any technical failures in the telephone lines, failure of servers or the failure to provide the correct Competition score updates or any mistakes arising out of technical snags. Further, Seven3Rockers/Aircel shall not be responsible for any claims arising out of any failure(s) which is beyond the reasonable control of Seven3Rockers or Aircel.

13. The subscriber/member hereby agrees and undertakes not to hold Aircel/ Seven3Rockers and/or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or remote that you may/might have suffered, sustained or incurred, or claim to suffer, sustain or incur, by way of and /or on account of the Competition Pack or any related Competitions.

14. Aircel and Seven3Rockers reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify any part of the Competition Pack or any part thereof including the Terms and Conditions and prizes/gifts at their sole discretion at anytime during it’s validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the Subscriber/member. You are therefore advised to check this website regularly for any update(s) or amendment(s) made to these Terms and Conditions.

15. This Competition is being made purely on a “best effort” basis and participation of eligible subscribers is voluntary, and subject to acceptance of these Terms and Conditions.

16. These Terms & Conditions are subject to Indian Law and the exclusive jurisdiction of the Courts in New Delhi. Any and all disputes, controversies and conflicts (“Disputes”) arising out of the Competition shall be referred for Arbitration to any Officer designated by Organizers. The place of arbitration shall be New Delhi and the language used in the arbitral proceedings shall be English. Subject to the dispute resolution procedure as set out herein above, the Courts at New Delhi shall have the exclusive jurisdiction.

17. A person who has already won a prize will automatically disqualify from winning other prizes on any other SIM card in his/her name on which he/she is playing the contest. This is a skill based quiz and you should answer the quiz using your own skills only.

18. The contest will be discontinued in the circle which does not have a requisite number of players (which can be a number to be decided and will be an absolute discretion of the company).

TERMS AND CONDITIONS – IPLAY Iwin

1.“IPLAY Iwin Competition” (hereinafter referred to as the “Competition”) jointly organized by Aircel I Limited, Aircel Cellular Limited, Dishnet wireless Limited  (hereinafter referred to as “Aircel India”) and Seven3Rockers technologies Limited (Seven3Rockers), jointly referred to as ‘Organizers’ is launched as part of the IPLAY Iwin Pack and is valid during the period from 1^st March 2013 00:00:01 hrs to 31^st May 2013 23:59:59 hrs* (hereinafter referred to as the “Competition Period”). Aircel India reserves the right to extend or shorten the Competition Period, as it deems fit.

            * “Competition period” for IPLAY I Win Competition has been extended till the midnight of 31^st May 2013.

2. The Competition is valid for all Valid Subscribers* i.e. both prepaid and postpaid of Aircel India (hereinafter referred to as “Subscribers”) residing in India who are above 18 years of age, in the circles (AP, ASSAM, BIHAR, DELHI, HP, KARNATAKA, KOLKATA, MAHARASTRA, MUMBAI, NE, ORISSA, JNK, PUNJAB, RAJASTHAN, WEST BENGAL, UPE) who successfully subscribe for the Competition Pack (hereinafter referred to as “Participant”) by following the process mentioned hereunder. Participating in this Competition by members of the IPLAY Iwin Pack is optional. The Competition will be available in the below mentioned languages:

*Valid Subscriber means having valid Subscription of Aircel cellular mobile telephony services as per Law.

An IPLay Iwin member, by subscribing to and/or participating in the competition, hereby agrees to the Terms and Conditions mentioned below and gives his/her consent to the process of selecting the winners as set out herein, and any appropriate changes that may be made to this competition by the Organizers due to any legal or regulatory requirement, instructions from any judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of Aircel/Seven3Rockers, its affiliates and associates.

Roaming callers should be barred from playing the Competition.

3. Procedure and Eligibility to participate:

The Competition is valid for all active Prepaid and Postpaid Aircel Subscribers who fulfil the following criteria:

Subscriber must be above 18 years of age.

Subscriber must be a citizen of India.

He/she must not have any been either convicted and / or prosecuted for commission of any criminal offence nor be of an unsound mind.

He/she must not be under any legal disability e.g. insolvency, restraint by court orders etc. and / or is prohibited from entering any contractual relationship.

Further, the winner will be the subscriber of the successful mobile phone number (MSISDN) and not the player, if such player is not the subscriber of such mobile number, as set out above. If the winner is not able to provide sufficient evidence to show that he/she is the subscriber of the mobile number, Aircel/Seven3Rockers reserves the right to award the prize to the next eligible winner or to forfeit the prize, at its sole discretion.

 Participation in the Competition will be construed as an acknowledgement and acceptance of the Terms and Conditions set out herein and further agreed to be bound by the Terms and Conditions stated herein.

4. Subscription Process

Only Aircel subscribers (refer clause 2 above) will be eligible to participate in the IPLAY Iwin Competition.

Competition will be available on the toll-free shortcode 51001 for all subscribers of the Competition Pack.

All subscribed participants on the first day of the Competition will be charged as per the pricing they had opted for at the time of subscription from 01:00:00 hours onwards.

- If the charging is successful, participant will get a confirmation SMS, along with the rules, prizes, Terms and Conditions URL, keywords and the short code  on which he/she can SMS and participate in the Competition.

All participants who subscribe to the Competition Pack, after the Competition starts, will be charged as per the pricing they had opted for at the time of subscription.

- If the charging is successful, user will get a confirmation SMS, along with the rules, Prize details, Terms and Conditions URL , keywords and the short code  on which he/she can SMS and participate in the Competition.

On subsequent days, the system will try to charge all participants Rs.5/day or Rs.30/10 day depending on the pricing option they had opted for at the time of subscription- at 01:00:00 hours, irrespective of successful charging or failure the previous charging attempt. This charge will not be refunded to participants under any circumstances.

Subscribers that do not have Rs. 5 balance will be charged as mentioned below:

- If the charging is successful, user will get a confirmation SMS, along with the rules, Prizes, Terms and Conditions URL keywords and the short code  on which he/she can SMS and participate in the Competition.

Every day, all subscribed participants of the Competition Pack will be sent the charging success SMS (if the charging is successful), along with the question.

All subscribed participants will be charged from the first day of the Competition, or the day he/she subscribes to the Competition Pack, till the end of the Competition, or the day till he/she unsubscribes from the Competition Pack, whichever happens first.

If the subscriber wishes to unsubscribe from the Competition Pack, that can also be done by sending SMS UNSUB PLAYIWN to 51001.

There will be 1 attempt for charging every day. The attempt will be made 24 hrs post subscription/renewal attempt.

All subscribers of the Competition Pack can play the Competition, by sending SMS to the shortcode 51001, after being charged for the day.

Based on the amount charged, subscribers will be allowed to answer questions

o Subscribers that are charged Rs 5/day will get to answer 20 questions /day.

o Subscribers that are charged Rs 30/10 day will get to answer 20 questions for next 10 days.

The MSISDNs will be allowed to play the Competition, only after subscribing to the Competition Pack and after being charged for the day.

The confirmation SMS sent by the application that a participant has been charged will be sent only after 8 am and before 9 pm for the day even though that the charging would happen anytime between 01:00:00 hours and 23:59:59 hours.

• All active subscribers of Aircel can play the Contest, on a toll free shortcode, by sending ‘PLAY’ to 51001.
• As soon as a participant sends the keyword, the participant can play the challenge, only if the subscription fails for any reason, he/she would be stopped from playing.
• The confirmation SMS that a subscriber has been charged will be sent only between 8 am and 9 pm on any given day, even though the charging might happen at anytime between 01:00:00 hours and 23:59:59 hours.
• If the charging is not successful, then user will get an SMS saying he/she has not been charged.
• There will be a black-out time of 30 minutes (from 11:45 PM to 12:15 AM) during which the questions will be refreshed for the next day. This black-out time will be communicated to all the subscribers of Competition pack at the time of subscription. The participants will not be allowed to play the competition during this black-out time.
• If the application receives a response/keyword to 51001 at any time during this half hour, the member will be informed that the Competition is unavailable/is being refreshed and members can SMS after 12:15 AM to play the questions of the next day.
• If the application receives responses like PLAY A /B or A/B to 51001 after 12.15 am then that will be considered as response to the 1st question of the new day and based on the right answer configured for the 1st question of the day the response will be sent along with the next question.
• A participant can play the Competition by either sending the keyword “PLAY” to 51001 to get the question, or by sending a response to the question like “A or B” to 51001 as an answer to the question that he/she has last received on that day.
• The Competition consists of a total of 1200 questions with 2 answer options each. The participant can play only 20 questions a day. There will be a fresh set of 20 questions every day.
• For every right answer, the participant will score 2 point. There is no negative marking for a wrong answer.
• After every right/wrong answer, the user will be given his/her score for the day, followed by the next question and call-to-action.
• If the member gives an invalid input then an SMS is sent saying invalid answer, followed by how to answer and the same question and answer options.
• If the participant stops playing the challenge after answering the nth question then when he/she sends the keyword on the same day, he/she will get the (n+1)th question.
• If the user stops playing the competition, then he/she can continue playing either by sending SMS PLAY to 51001, on the same day, to receive the next question.
• The questions will be played sequentially.
• If a participant has answered only 3 questions the previous day and sends the answer to the 4th question the next day then the system will accept it as the response for the 1st question of the new day and give an appropriate response (right/wrong) along with the next question.
• Once the participant has played all the 20 questions for the day, he/she will receive an exit SMS informing him/her that he/she has reached the limit for the day, and can answer a fresh set of 20 questions the next day. The same will happen if the participant sends the keyword again after he/she has answered all the 20 questions for the day.
• But on the last day of competition, the exit text will not inform the subscriber that he/she can play the Competition on the next day.
• In case a participant experiences a delay in receiving a response or receives no response at all from the system, at any time during the challenge period, he/she should SMS the challenge keyword PLAY to the toll-free number 51001. The subscriber should refrain from sending the answer options, ‘A’ or ‘B’ in such a situation to 51001, as it might be considered as a reply to an unanswered question.
• The points scored by the participant in a day will get carried over to the next day. His/her score will be added at the end of each day.  The selection of the winner for weekly prize will be based only on the points scored by a participant in that week.
• All subscribers of the challenge who have NOT played the competition for the last 3 days will be sent an SMS asking them to play the competition by sending the keyword to 51001. This SMS will also contain the method of unsubscribing from the IPLAY Iwin competition pack so that subscribers are educated about the same.

5. Pay as you Play Subs:

• All active subscribers of Aircel can play the Contest, on a chargeable shortcode, by sending ‘IPLAY’ to 51001.
• As soon as a participant sends the keyword, the participant can play the challenge by sending the response to the chargeable shortcode 510010 (@Rs.3/SMS), only if the request fails for any reason, he/she would be stopped from playing.
• The confirmation SMS that a subscriber has been charged Rs.3 will be sent only between 8 am and 9 pm on any given day, even though the charging might happen at anytime between 01:00:00 hours and 23:59:59 hours.
• If the charging is not successful, then user will get an SMS saying he/she has not been charged.
• There will be a black-out time of 30 minutes (from 11:45 PM to 12:15 AM) during which the questions will be refreshed for the next day. This black-out time will be communicated to all the subscribers of Competition pack at the time of subscription. The participants will not be allowed to play the competition during this black-out time.

• For every right answer, the participant will score 2 point. There is no negative marking for a wrong answer.
• After every right/wrong answer, the user will be given his/her score for the day, followed by the next question and call-to-action.
• If the member gives an invalid input then an SMS is sent saying invalid answer, followed by how to answer and the same question and answer options.
• If the participant stops playing the challenge after answering the nth question then when he/she sends the keyword on the same day, he/she will get the (n+1)th question.
• If the user stops playing the competition, then he/she can continue playing either by sending SMS IPLAY to 51001, on the same day, to receive the next question.
• The questions will be played sequentially.
• If a participant has answered only 3 questions the previous day and sends the answer to the 4th question the next day then the system will accept it as the response for the 1st question of the new day and give an appropriate response (right/wrong) along with the next question.
• Once the participant has played all the 25 questions or answered first 20 questions correctly for the day, he/she will receive an exit SMS informing him/her that he/she has reached the limit for the day, and can answer a fresh set of 25 questions the next day. The same will happen if the participant sends the keyword again after he/she has answered all the 25 questions or answered first 20 questions correctly for the day.
• But on the last day of competition, the exit text will not inform the subscriber that he/she can play the Competition on the next day.
• In case a participant experiences a delay in receiving a response or receives no response at all from the system, at anytime during the challenge period, he/she should SMS the challenge keyword IPLAY to the toll-free number 51001. The subscriber should refrain from sending the answer options, ‘A’ or ‘B’ in such a situation to 510010, as it might be considered as a reply to an unanswered question.
• The points scored by the participant in a day will get carried over to the next day. His/her score will be added at the end of each day.  The selection of the winner for weekly prize will be based only on the points scored by a participant in that week.

One MSISDN cannot win a monthly prize more than once in the challenge.

• Weekly Prize: Only the top scoring MSISDN in the circles where contest is live charged on all the 7 charged days will be considered eligible for Weekly prize. Only the scores of days on which the MSISDN was charged will be considered. In case of a tie, the winner will be selected through a random system generated process which will be scrutinized by an independent audit mechanism. One MSISDN cannot win a weekly prize more than once in the challenge.

If a participant plays the contest every day, his/her score will be added at the end of each charged day. i.e. if the participant has started playing the contest on day 1 and has scored 2 points, if he/she drops the game and resumes playing through SMS on day 3, he/she will be given fresh questions for day 4 (one by one), and if he/she answers the question correctly, his/her score will be 4. And this will be the score that will be considered for the winner selection for all the prizes.

The list of winners of all prizes will be announced after the end of the Competition and after all the winner selection processes are completed.

Gratification Distribution Guidelines:

All prizes will be given after deducting various taxes, license fees and charges as applicable.

1.      All decisions of Organizers on the selection of winners shall be final and binding and no correspondence or communication shall be entertained in this regard.
